1. Definitions Used in Terms and Conditions
Company - SIA 976, registration No. 40203602834, legal address: Hospitalu Street 26-13, Riga, Latvia.
Internet Shop - Company-maintained website www.preludejewelry.com, where it is possible to purchase Goods.
Goods - products or services offered in the Internet Shop.
Client - A person who uses the Internet Shop to purchase Goods or obtain information about them.
Terms and Conditions - These Terms of Use of the Internet Shop, which constitute a distance contract between the User and the Company.
Policy - The Company's Privacy and Personal Data Protection Policy document, available here.
2. General Provisions
2.1. These Terms and Conditions regulate the legal relationship between the Client and the Company concerning the purchase and delivery of Goods. By registering on the Internet Shop and/or making a purchase, the Client confirms their agreement with these Terms and Conditions.
2.2. The Client is prohibited from disclosing their Internet Shop access credentials to third parties. The Client understands and agrees that all actions taken on the Internet Shop using their access credentials are binding to them.
2.3. The Company undertakes to comply with its Privacy Policy and the requirements of personal data protection laws as per the regulations of Latvia and the European Union.
3. Order of Goods and Payment Procedure
3.1. Information about Goods and their prices is displayed in the Internet Shop alongside the respective Goods. Prices and delivery costs are valid at the time of placing the order. The Company reserves the right to change prices at its discretion at any time; however, such changes will not affect orders that have already been placed and paid for.
3.2. Prices are listed in euros (EUR) and include value-added tax (VAT). Delivery costs are calculated and displayed separately.
3.3. The Client places an order by selecting Goods and adding them to the shopping cart. The Client may continue browsing and adding Goods before proceeding to payment.
3.4. At the time of ordering, the Client must specify the delivery type and address for receiving the Goods.
3.5. Payment for Goods and their delivery must be made using one of the payment methods provided in the Internet Shop.
3.6. The order is considered complete and binding for both the Client and the Company once payment has been received for the Goods and delivery.
3.7. The Company will send an order confirmation to the email address provided by the Client.
3.8. Upon receiving full payment for Goods and delivery, the Company will deliver the ordered Goods to the address specified by the Client. The Client is responsible for complying with the rules of the chosen delivery provider, such as working hours or deadlines for receiving the Goods.
4. Supply of Goods
4.1. Delivery fees depend on the chosen delivery method and location and are displayed at the time of ordering.
4.2. Delivery of Goods is carried out only after full payment has been received.
4.3. If the Client selects courier delivery, they must provide accurate and complete delivery information (e.g., door code, floor, precise building entry). The Company is not liable for delays caused by incomplete or inaccurate information provided by the Client.
4.4. Before accepting the Goods, the Client must check the packaging for any damage or irregularities. Any issues must be noted on the delivery documentation, and the Company must be notified.
4.5. If the Company cannot supply the ordered Goods due to unforeseen circumstances, it reserves the right to offer a replacement GOOD of equivalent value upon the Client's consent.
4.6. The Company reserves the right not to deliver Goods if the Client has not made full payment for the Goods and their delivery or has outstanding unpaid orders.
5. Right of Withdrawal
5.1. Only Clients who are consumers have the right to withdraw from the purchase agreement.
5.2. Consumers may unilaterally withdraw from the purchase agreement within 14 days from receiving the Goods, notifying the Company in writing.
5.3. To exercise the right of withdrawal, the Client must email the Company, including their personal details, order information, bank account details, and the reason for withdrawal.
5.4. Upon withdrawal, the Company will refund the amount paid for the Goods within 14 days of receiving the returned Goods and verifying their condition.
5.5. The right of withdrawal does not apply to custom-made or personalized Goods.
6. Privacy
6.1. All personal data entered in the Internet Shop are processed in accordance with the Company's Privacy Policy and applicable laws regarding personal data protection.
6.2. By registering or using the Internet Shop, the Client consents to the processing of their personal data as outlined in the Policy.
6.3. The Client agrees that their personal data may be transferred to third parties (e.g., delivery companies, payment processing services) to ensure the proper execution of services.
7. Final Provisions
7.1. All intellectual property rights related to the Internet Shop and its content are the exclusive property of the Company.
7.2. All disputes between the Client and the Company will be resolved through negotiation or in accordance with the laws of the Republic of Latvia and the European Union.
7.3. Invoices are prepared electronically and are valid without a signature. Invoices are sent to the Client's email address provided during registration.
7.4. If the Client violates the Terms and Conditions or applicable laws, the Company reserves the right to deny access to the Internet Shop, cancel orders, or refuse service.
